1. DEFINITIONS
The “Freeware Software” means the software program covered by and incorporating this Agreement, and all related documentation and all related updates.
2. LICENCE
This Agreement allows you to:
(a) Use the Freeware Software on a computer for amateur radio and hobby purposes;
(b) Make one copy of the installed Freeware Software in machine-readable form solely for back-up purposes. You must reproduce on any such copy all copyright notices and any other proprietary legends found on the original;
(c) Distribute copies of the original non-installed compressed file or files without any alteration or addition providing no charge is made other than any direct cost of media utilised.
3. RESTRICTIONS
(a) You may not decompile, reverse engineer, disassemble, or otherwise reduce the Freeware Software to a human-perceivable form. You may not modify, sell, rent, transfer, resell for profit, distribute or create derivative works based upon the Freeware Software or any part thereof.
(b) You may not use the Freeware Software for any commercial purpose or application.
(c) You may not install or use the Freeware Software on any computer that is or may be used for business critical, mission critical or life-safety applications and purposes.
4. OWNERSHIP
The forgoing licence gives you limited rights to use the Freeware Software. You do not become the owner of, and I retain title and copyright to, the Freeware Software and all copies thereof. I reserve all rights not specifically granted in this Agreement.
5. DISCLAIMER OF WARRANTIES AND TECHNICAL SUPPORT
The Freeware Software is provided to you free of charge, and on an ‘AS IS’ basis, without any technical support or warranty of any kind including, without limitation, a warranty of satisfactory quality, fitness for any particular purpose and non-infringement.
6. LIMITATION OF DAMAGES
You install and use the Freeware Software entirely at your own risk. Neither I nor my suppliers and contributors shall be liable for any direct indirect, special, incidental or consequential damages or loss nor for any damages for loss of business, loss of profits, loss of anticipated savings (or the like), nor for any other form of loss whatsoever whether based on breach of contract, tort (including negligence), product liability or any other legal principle.
7. GENERAL
(a) The limited warranty and limited liability set forth above are fundamental elements of the basis of the bargain between us. You agree that I would not be able to provide the Freeware Software on an economic basis without such limitations
(b) If any part of this Agreement is found by any court or competent authority to be invalid, unlawful or unenforceable in any jurisdiction, then that part shall be deemed not to be a part of this Agreement. Such part shall not affect the enforceability of the remainder of this Agreement, nor shall it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.
(c) Each party hereby irrevocably agrees that the courts of England shall have exclusive jurisdiction to resolve any controversy or claim of whatever nature out of or relating to this Agreement or breach thereof, and the laws of England shall govern such controversy or claim.
(d) This Licence is displayed for your acceptance and agreement when you install the Freeware Software and is also included within the Help File (if any). If you subsequently disagree with any of its terms you must immediately discontinue use of the Freeware Software and uninstall it from your computer together with any back-up copy that may have been made.
(e) You agree to read the Help File and any other included instructions or recommendations for use of the Freeware Software and agree to use the Freeware Software only in accordance with such instructions and recommendations.
(f) This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
